Painting contractor sues Centerplan, Arch over ballpark work

A Danbury painting and insulation contractor for Hartford’s Dunkin’ Donuts Park is suing the former developer and surety alleging the “unreasonable” withholding of payment for work done at the venue.

Green Comfort Solutions (GCS) filed suit Dec. 19 in Hartford Superior Court seeking payment of $130,530 for work it completed at the ballpark as a subcontractor for former developer Centerplan Construction Co.

In addition to nonpayment by Centerplan or under the bond filed by the surety, Arch Insurance, which is guaranteeing completion of the minor league stadium, GCS alleges Centerplan breached its implied duties, covenants of good faith and fair dealing, and the Connecticut Unfair Trade Practices Act. The firm also alleges Centerplan has been “unjustly enriched” by withholding payment.

Implied duties included coordination of the work “so as not to frustrate” the contractor, the lawsuit states. But according to the complaint, Centerplan obstructed the contractor’s progress by allowing of drywall and mechanicals to prevent the spraying of insulation and by failing to provide adequate electricity, among other claims.

Hartford Mayor Luke Bronin fired Centerplan in June and Arch hired another contract to complete the work by opening day, April 13, in 2017 for the Hartford Yard Goats minor league team.

City officials and Centerplan are engaged in mediation of one of several court cases involving the ballpark, but Arch has indicated the new contractor is on track to complete the stadium on time.

The Yard Goats completed their entire 2016 season on the road.

Arch declined comment. Centerplan executives could not be reached for comment.
