Institute to appeal Ariz. ruling on energy mandate

The Goldwater Institute says it will appeal a court ruling that upholds the Arizona Corporation Commission‘s requirement that electric utilities get some of their power from solar and other renewable sources.

The institute said it plans to appeal the ruling by Judge Joseph Heilman of Maricopa County Superior Court to the state Court of Appeals by the end of the September.

The institute had filed a suit challenging rules that the commission adopted in 2006 requiring utilities to gradually increase their use of renewable energy sources so they reach at least 15 percent by 2025.

Heilman said the rules fall within the commission’s constitutional authority to set rates. (AP)
