Guilford business owner pleads guilty to tax offense, agrees to pay $1.4M in restitution

A Guilford woman faces five years in prison after pleading guilty to a federal tax offense stemming from her failure to pay business payroll taxes.

Michelle Ann Gilson, 38, who co-owned and co-operated Guilford-based package delivery company B&M Package Solutions Inc., was responsible for managing the company’s books, payroll and invoices, authorities said.

Under the Federal Insurance Contribution Act (FICA), Gilson was required to collect federal taxes from her employees, such as Medicare and Social Security taxes.

She was also responsible for ensuring that B&M Package Solutions and another package delivery company she previously owned and operated, Epic Empirez, paid their federal payroll taxes as employers.

Authorities say that, starting in 2017, Gilson failed to report employees’ federal income and FICA taxes, and failed to pay withheld amounts to the IRS.

Gilson pleaded guilty Thursday before U.S. District Judge Vernon D. Oliver in Hartford to one count of willful failure to pay over withholding taxes. In doing so, she admitted the offense occurred over multiple quarters from 2017 to 2022, authorities said.

She faces a maximum of five years in prison when she is sentenced on Oct. 9. 

Gilson, who has been released on bond, also agreed to pay roughly $1.4 million in restitution to the IRS.
