Foxwoods retail outlets owner suing CT co-developer for overpayment

The majority owner of a newly built shopping outlet center at Foxwoods is suing its Connecticut-based development partner this week, alleging that he has not returned an overpayment of approximately $600,000.

Tanger Factory Outlets filed suit Wednesday in U.S. District Court in New Haven against corporate entities controlled by Sheldon Gordon — a longtime retail developer who built the Forum Shops at Caesar’s Palace in Las Vegas.

Tanger, which debuted its Tanger Outlet Center-Foxwoods in May, alleges in the suit that Gordon has not returned an overpayment of $568,000 in development fees.

The suit says Tanger agreed in 2012 to pay Gordon a fee of 2.5 percent of hard costs of the $129 million retail center, but last year amended the agreement, capping Gordon’s total fee at $1 million.

The suit alleges breach of contract, unjust enrichment, civil theft and violation of the state’s unfair trade practices act.

Tanger’s attorneys did not respond to a request for comment. An attorney for Gordon has not yet been entered into court records. A message left Friday morning at Gordon’s corporate office in Florida was not immediately returned.
