The former developers of Dunkin’ Donuts Park are appealing a court ruling that found the Hartford Yard Goats did not “meddle” in relations with the Capital City over ballpark construction changes and cause their firing.
On Wednesday, Centerplan Construction Co.and DoNo Hartford filed a notice of intent to appeal Hartford Superior Court Judge Thomas Moukawsher’s Nov. 27 summary judgment to the appellate court. The appeal itself has not yet been filed and Centerplan attorney Raymond Garcia on Friday declined comment.
The developers had sued the ballclub and owner Josh Solomon in July of 2016, alleging that the team pressed the city of Hartford for changes to the ballpark that the Yard Goats didn’t intend to pay for. They also alleged such actions caused the city to fire Centerplan in June of 2016.
In his summary judgment, Moukawsher said the developers lacked evidence to prove proposed work changes “hobbled” the developers.
“Cost cutting measures may have been rejected, changes may have been made, some delays may have happened,” the judge wrote, “but to raise genuine issues of fact for trial, DoNo and Centerplan would have to offer material evidence connecting these events to some wrongdoing.”
The city ultimately hired a different contractor to finish the work and the team went on to host its first season in the ballpark this year.
