ERISA suit against ex-Bristol firm’s estate

Federal labor regulators are suing operators on behalf of workers at a defunct Bristol firm to collect their $83,780 in unremitted pension contributions.

The U.S. Department of Labor said Thursday it is suing in Connecticut federal court Scott Federowicz and Kathryn Shea Federowicz, trustees of former Partners Communication Inc. which ceased operations in October 2008.

The couple could not be immediately located Thursday for comment.

The suit, brought under provisions of the Employee Retirement Income Security Act of 1974 (ERISA), claims the Federowiczes failed to remit wage contributions collected from employees who had performed work under state prevailing wage contracts beginning Jan. 1, 2005.

The suit asks the court to order the defendants to restore to the plan all resulting losses plus interest.

The suit also asks the court to order the defendants to make sure that appropriate allocations and disbursements are made to each of the plan’s participants whose plan accounts were underfunded, and then to ensure that the plan is properly terminated.
