The developer suing the city over its firing as the builder of Dunkin’ Donuts Park has asked the judge in Hartford Superior Court to “preserve” the site as evidence in its case, a move that could block expected continued construction.
Earlier this week, Arch Insurance, the insurer guaranteeing completion of the ballpark, tapped Baltimore-based Whiting-Turner Contracting Co. to complete the work.
Middletown developer Centerplan Construction Co. and DoNo Hartford LLC said in a motion filed Thursday that the court should order the preservation of evidence. Any “alterations” at the site could prevent Centerplan and DoNo Hartford LLC from “marshalling the evidence necessary to defend themselves and assert further claims,” the court document states.
The city of Hartford fired the developers in June after “losing confidence” in their ability to meet deadlines. The Yard Goats minor league team played its entire season on the road.
