Business owner gets 15 months in prison, must pay $1M restitution for bid-rigging

The co-owner of an Oxford-based insulation contracting company was sentenced Friday to 15 months in prison for his role in a $45-million-dollar bid-rigging scheme that targeted hospitals, municipalities, private businesses and universities around the state.

Michael S. Flynn, a co-owner of BC Flynn Contracting Corp., must pay $1,062,155 in restitution.

Flynn was sentenced in U.S. District Court in Bridgeport, and he had pleaded guilty in May 2019 to bid-rigging and conspiracy to commit wire fraud in connection with the scheme. Flynn was also ordered to pay a special assessment of $200.

Flynn is scheduled to surrender to the Federal Bureau of Prisons March 13.

Yale University, the University of Connecticut, city of Hartford, PepsiCo. Inc., and Stamford Hospital were among the victimized institutions, according to the U.S. Attorney’s office. 

Flynn was the last of seven to be sentenced following an investigation into the insulation contracting industry.

Flynn had been charged with conspiring with other insulation contractors to rig bids for construction projects, according to the U.S. Attorney’s office. The conspiracy ran from 2011 though 2018. The co-conspirators allegedly discussed and agreed on bid amounts to inflate prices and profits.

U.S. Attorney Vanessa Roberts Avery said the penalties imposed should act as a deterrent.

“This defendant’s collusive conduct victimized hospitals, universities and businesses throughout Connecticut,” she said.

In September, Thomas F. Langan, the co-owner of North Haven insulation contracting firm Langan Insulation LLC was sentenced to one year and a day in prison for his role in the conspiracy. Langan was ordered to pay a $20,000 fine and $480,900 in restitution.
