Zoning officials have approved the construction of a 50-unit apartment complex in downtown Fairfield following a three-year court battle with the developer. The plans still need to be approved by a state Superior Court judge who has presided over the legal tussle.
Lee Forest, a Stratford family doctor doing business as 15 Unquowa Road, LLC, plans to build the five-story, 57,230-square-foot building, at 15 Unquowa Road.
The apartment building would replace a two-story, 11,078-square-foot building, three one-story buildings containing about 800 square feet each and a 1,216-square-foot building, property records show.
Forest, who has not returned emails asking about the project, had proposed building a 63-unit apartment building on the site in 2022, but the Planning and Zoning Commission denied that plan, according to documents filed with the town.
Two years later, Hartford Superior Court Judge Stephen Frazzini overruled the commission’s denial of the project. The commission appealed the judge’s ruling in February.
In June, the commission approved a plan for 50 apartment units with stipulations in a settlement with the developer. Conditions include deeming eight units as affordable housing and reducing the building height to 56 feet from 66 feet. The agreement also requires 2,250 feet of commercial space on the ground floor and another 1,000 square feet of commercial space on the same level as a 27-space, basement-level garage area.
